ARTICLE 1 - Hosting - Production

The Website is hosted by SALESFORCE.COM EMEA Limited, whose registered office is at Floor 26 Salesforce Tower, 110 Bishopsgate, London EC2N 4AY, United Kingdom, registered in the Companies Register of England and Wales under number 05094083, with intra-community VAT number GB844903710, represented by José Luiz Moura Neto.

The website is produced by OSF Global France S.A.S.U., a simplified single-shareholder company, whose registered office is located at 12 place de la Défense, Maison de la Défense, 92974 Paris La Défense Cedex, registered in the Nanterre Trade and Companies Register under number B 750 118 895 and represented by its president Gerard Szatvanyi.

The Website's Publication Director is Mr. Alexandre ZEMMOUR.

ARTICLE 2 - Definitions

“User”: this term refers to any individual over the age of 18 who is not a merchant and who accesses the Site and/or uses the Site's features.

“Publisher”: this term refers to the company GENERALE POUR L’ENFANT, which publishes and produces the content of the website www.sergent-major.com 

“Site”: this term refers to the website www.sergent-major.com.

ARTICLE 3 - Purpose

The purpose of these Terms of Use is to define the terms and conditions for making the Site and its content available to a User and, in particular, to define the conditions of access and/or use of the Site by a User.

Any access and/or use of the Site implies acceptance of and compliance with all the terms of these Terms of Use and their unconditional and unreserved acceptance by the User. If the User does not agree with all or part of the provisions of these Terms of Use, they must refrain from using the Site.

Their disclosure shall in no way be interpreted as granting any license or right to use said trademarks and distinctive elements protected by copyright. They may not therefore be used under penalty of infringement.

Nothing in these Terms of Use or in the content of the Site shall be interpreted as directly or implicitly granting any license or right other than that of consulting the Site.

The Publisher strives to ensure that the information published on the Website is accurate and up to date, and reserves the right to correct the content at any time without notice. However, GPR cannot guarantee the accuracy, precision, or completeness of the information made available on the Website.

The Publisher may interrupt all or part of access to the Site, in particular for maintenance, upgrading, or any other reasons, including technical or legal reasons. The Publisher cannot under any circumstances be held liable for these interruptions or the consequences that may result from them.

The User is solely responsible for the use made of the Site and cannot hold the Publisher liable for any claim and/or proceedings brought against it as a result of such use. The Publisher disclaims all warranties, express or implied, including those relating to the quality and compatibility of the Site for the specific uses made of it by the User.

The Publisher offers no guarantee against intrusion and cannot be held liable to the User for damage to or alteration of equipment, including but not limited to computer equipment, mobile devices, or cell phones.

Consequently, the Publisher declines all responsibility in the event of:

Interruption of the Site;
The occurrence of bugs;
Inaccuracy or omission relating to information available on the Site;
Damage resulting from fraudulent intrusion by a third party leading to a modification of the information made available on the Site;

Any access and/or use of the Site by a minor User remains the sole responsibility of the holder(s) of parental authority over the minor User concerned.

ARTICLE 10 - Changes to the Terms of Use

The Publisher reserves the right to unilaterally modify the content of these Terms of Use at any time. The modified Terms of Use shall come into force as soon as they are posted on the Website. As such, the Publisher invites the User to regularly review the Terms of Use. The User is informed that the latest version of the Terms of Use will govern their access to and/or use of the Website. The User agrees not to claim any compensation following the interruption, suspension, or modification of these Terms of Use.

ARTICLE 11 - Personal data collected

The Publisher collects, uses, stores, and transmits certain personal data provided by Customers in strict compliance with French data protection law, in particular the provisions of Law No. 78-17 of January 6, 1978, known as the “Data Protection Act,” " and those of Regulation No. 2016/679 on data protection of April 27, 2016.

The Publisher reports on these provisions and the rights of Users on the Privacy Policy tab of the website www.sergent-major.com.

By agreeing to these Terms of Use, the User consents to the Publisher, as data controller, processing their data collected for the performance of this contract. This data will be kept only for the time necessary to fulfill the purpose for which it was collected, unless otherwise required by law. It may only be communicated to the Publisher's internal departments and service providers involved in the purpose described above.

The User has the right to access, rectify, oppose, and erase their data. To exercise these rights, please send a letter specifying your request, accompanied by proof of identity.

ARTICLE 12 - Nullity and waiver

In the event that any clause of these Terms of Use is declared null and void or contrary to mandatory laws or public policy, it shall be deemed unwritten but shall not invalidate the other clauses.

The fact that the Publisher does not invoke any of the clauses herein at a given time shall not constitute a waiver of the right to invoke those same clauses at a later date.


ARTICLE 13 - Term

The term of these Terms of Use is indefinite. They shall take effect with respect to the User upon access and/or use of the Site.

ARTICLE 14 - Applicable law and disputes

These T&Cs are governed by French law. The language of these T&Cs is French.

In the event of a dispute, the French courts shall have sole jurisdiction. Any dispute arising from the application, interpretation, or execution of these Terms and Conditions, or related to the use of the Website or any purchase made on the Website, shall be brought before the courts of the Customer's place of residence, failing which before the courts of Bobigny, regardless of the place of Order, delivery, and payment or method of payment, even in the event of a warranty claim or multiple defendants.

The Site complies with French law, and under no circumstances does the Publisher guarantee compliance with any local legislation that may be applicable when the User accesses the Site from other countries.
